Company name (“Vaxisure”) is the publisher and author behind the internet resource https://www.vaxisure.in. The Company name is the owner and the operator of all the services that can be availed from the website..

1. NATURE AND APPLICABILITY OF TERMS AND CONDITIONS

It is requested to peruse through the Privacy policy and Terms and Conditions available on the website, www.vaxisure.in before deciding to access the website or make use of the services that are being provided through our website by Vaxisure.

The Privacy Policy and Terms of conditions together comprise a legal document between Vaxisure and you in context of your access to the website and your usage of our services (defined below)

The agreement is applicable to you if you are -

  • A healthcare provider or a medical Practitioner (whether working in an organisation/ institution or as an individual Practitioner) wanting to get listed on the website, or are already listed on our website, including the authorized and designated associates of those Practitioners or organisations.
  • A patient, his/her affiliates or representatives, looking for Practitioners using the website
  • Any other individual or organisation using the website.

The agreement is applicable to the services which are offered by Vaxisure through the website and are provided for free to the users, who include the following:

For Practitioners: The listing of the Practitioners, their profiles, and contact information, for the purpose of being available to the visitors and users of the website;

For other users: The provision of

(i) Creating and maintaining ‘Health accounts’. (ii) Looking for Practitioners by their name, specialization, geographical location or other criteria specially developed and provided by Vaxisure on the website, (iii) Booking appointments with the Practitioners.

The services can undergo modifications from time to time, solely at the discretion of Vaxisure. The agreement applies to your use and visit to the website for availing the services, along with all the personal information voluntarily provided by you at any given time on the website.

The agreement stipulates the terms and conditions relating to your use of the website and explains the way in which your account would be treated by us as long as you are our registered member. In case of any questions or queries regarding any section of the Agreement, you can freely contact us at @Vaxisure.com.

By accessing and downloading the website for using the services, you are irrevocably accepting all the Terms and Conditions defined in the Agreement and the Privacy policy available through the website, and agree to abide by all of them. This agreement supplants all the previously written and oral terms (if any) which would have been conveyed to you previously in context of the usage of the website for availing the services.

It’s our right to terminate or modify any section of the Agreement at any time and on any grounds, and those modifications would be communicated to you in writing. You must go through the agreement regularly. By using the website after the modifications have been made to the agreement points to your compliance to be bound and follow the modified agreement.

By availing the services provided through the website, you are acknowledging that you are bound to the agreement. In case you disagree with any section of the Agreement, you are requested not to avail the services or use the website.

Your usage and access to any of the services provided by the website are solely at Vaxisure’s discretion.

The agreement is governed by and complies to the following provisions of the Indian Law, including but not restricted to:

 

  • The (Indian) Information Technology Act, 2000,
  • The Indian Contract Act, 1872,
  • The guidelines, clarifications, rules and regulations provided within the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the "IG Rules"). And the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the "SPI Rules").

2. CONDITIONS OF USE

It is mandatory to be of 18 years or older for registering, availing the services, visiting or using the website any way. When you accept the agreement or register, visit and use the website, you are warranting to Vaxisure that you are 18 years or older in age, and you have the authority and right to avail the services provided by the website and agreeing to abide by the agreement.

 

3. TERMS OF USE APPLICABLE TO ALL USERS EXCEPT PRACTITIONERS

 

The terms stipulated in the Clause 3 of the Agreement apply only to the users other than the Practitioners.

3.1 DATA PRIVACY AND END-USER ACCOUNT
  • 3.1.1 The terms “sensitive personal information or data” and “personal information” have been stipulated under the SPI Rules, and are reused within the Privacy Policy.
  • 3.1.2 Through the use of our services and website, Vaxisure collects information about the device being used for accessing the website along with anonymous data regarding your usage. The information is collected and used only to improve the quality of services provided by Vaxisure and develop new services.
  • 3.1.3By using the website, Vaxisure gets access to the registered User’s phone number or personal email, which would only be used for communication purposes, with the intention of providing you a better means to book appointments and obtain feedback from the users regarding the Practitioners, and the quality of their practice.
  • 3.1.4Vaxisure does not take any responsibility for the authenticity behind the sensitive personal information or data or personal information or any other type of information provided by the Website users to Vaxisure or to anyone associated with or acting on behalf of Vaxisure
  • 3.1.5It is the responsibility of the registered Users to maintain the confidentiality of their account’s access information and password. For any kind of usage of the user’s account and password, the user is solely responsible, even if the usage has not been authorized by the user. In case the users suspect that their account information and password has been used in an unauthorized manner, they should immediately notify Vaxisure. In case of such an unauthorized use, Vaxisure does not accept liability for any losses incurred by the user, rather the user is liable for any losses incurred by Vaxisure and other associated parties.
  • 3.1.6 Vaxisure has the sole discretion and rights to discontinue the services of those users who Vaxisure suspects on reasonable grounds of submitting inaccurate, untrue or incomplete information or those users who have actually submitted inaccurate, untrue or incomplete information.
  • 3.1.7 Vaxisure has the right to collect and use information from time to time from the users to debug any issues pertaining to customer support.
3.2 RELEVANCE ALGORITHM

The relevance algorithm used by Vaxisure for displaying the Practitioners is a completely automated system which lists Practitioners, their profile and any information relevant to their Practice on the Website. The listings of Practitioners are not a representative of any fixed or objective ranking or any endorsement for a particular Practitioner made by the Website. The relevance of the Practitioners may change from time to time and Vaxisure does not accept any liability for such changes. The automated computation system which lists the Practitioners takes into consideration various factors including but not limited to the inputs left by the registered users in the form of their feedback and comments. For improving the listing algorithm, the influencing factors of the algorithm may also change from time to time. Under no circumstance is Vaxisure responsible for the relevance and accuracy of the listing order.

3.3 DISSEMINATING INFORMATION AND LISTING CONTENT
  • 3.3.1 Directly or indirectly Vaxisure is engaged in collecting and displaying on the Vaxisure.com website all the relevant information pertaining to those Practitioner's profile and practice who have been listed on the website, including the details like qualification, specialization, location, fees, visiting hours, etc. Vaxisure endeavours to ensure that all that information is updated regularly and frequently. In spite of diligently screening and verifying the photos and information provided by the Practitioners, Vaxisure is not liable for any incompleteness or inaccuracies present within them.
  • 3.3.2 All the services provided by Vaxisure and by any of its service providers and licensors are offered on an “as available’ and "as is" basis, and sans any conditions and warranties (implied or expressed, constituting the suggested warranties of merchantability, fitness and accuracy of a specific title, purpose, and non-infringement, emerging by by statute or any other way in law or trade or usage). Vaxisure makes no representation and does not provide any guarantee or warranty, implied or expressed about the Services or provided in the Website. Vaxisure makes no guarantee about the completeness or accuracy of any information or content submitted by the Users on Website. Vaxisure disclaims to the maximum extent allowed by law any and all the liability emerging from the User’s reliance or use of the Services, the Website, the warranties and representations of the other Users, the information or content submitted on the website.
  • 3.3.3 The Website vaxisure.com can be linked to other websites of affiliates, business partners or other third parties. Vaxisure claims to have no control over, and no liability or responsibility for the content, reliability, validity, accuracy, quality of those websites or any content presented through our Website. Including any link on our website does not imply that Vaxisure is endorsing that linked site. The users can avail the services of those websites and use such links, but at their own risk.
  • 3.3.4 Vaxisure is not at all responsible or liable for any kind of damage or issues like viruses that can infect the equipments of the Users because of accessing, using, browsing through the Website or downloading any material, text, data, video content, audio content or images from such Website. In case the user has issues with the website, he/she can contact and avail help from the Vaxisure support and in case is still dissatisfied, can discontinue the use of the Website.
3.4 BOOK APPOINTMENT FACILITY
  • The method that Vaxisure uses to enable its users to connect with the Practitioners include the booking facility which allows the users to directly book appointments using the website.
  • 3.4.1 Vaxisure will ensure that users can confirm their appointments through the booking facility. However, Vaxisure is not liable for the scenario where the Practitioner cancels the appointment later, or that Practitioners cannot ensure his/her availability for the appointment.
  • 3.4.2 The User should be aware that Vaxisure does not accept its involvement during the provision of any medical advice or health care or diagnosis and thus, does not hold itself responsible for any kind of interactions that happen between the Practitioner and the user. This means that the user has understood and would agree to the fact that Vaxisure accepts no liability for:
    • Interactions between the Practitioner and the user and any other associated issues existing between the User and the Practitioner;
    • The intent or ability of the Practitioner(s) or rather its lack in fulfilling the responsibilities towards the Users;
    • Any bad treatment or wrong medication being prescribed by the Practitioner(s), or any kind of medical negligence shown by the Practitioner(s);
    • Any inappropriate behavior or misconduct observed on the part of the practitioner or the staff of the Practitioner ;
    • No Show or cancellation is done by the Practitioner or getting the booked appointment rescheduled or any other change in the fees being charged.
  • 3.4.4 Users have the facility of providing feedback regarding their experiences, however, it should be ensured that all those are provided in accordance to the law applicable to the feedbacks. The User should also be clear that in spite of the feedbacks, Vaxisure has no obligation to act in a manner that is in response to the contents of the feedback, including suggestions like delisting a specific Practitioner from the company’s website.
  • 3.4.5 The following are the terms and conditions relevant to the scenario of a  'Patient-No-Show (P.N.S)' (which is defined below), a case where a User does not appear at that's Practitioner's clinic in spite of booking the appointment:
    • There will be a temporary deactivation of the User's account and The Users won't be allowed to book further online appointments through that account on vaxisure.in for the coming four months in case of three valid PNS, in accordance to the Patient-No-Show policy. However, the user is still allowed to call the clinic through vaxisure.in for getting an appointment.
    • In the context of the terms and conditions, Patient- No-Show (P.N.S) can be as a case where the User, who had booked an appointment on the Vaxisure website with the help of the Book Appointment facility, did not show up for the appointment without prior cancellation/rescheduling/informing the concerned Practitioner in advance regarding the same. When the concerned Practitioner informs Vaxisure of the particular incident or marks a specific appointment as P.N.S within five days of the scheduled appointment, an SMS ("PNS Communication") and an email will be forwarded to the user for confirming the reason for the no-show. In case, the user is incapable of providing a legitimate reason for the no-show, Vaxisure will take the necessary actions. It should be understood that the actions taken by Vaxisure are meant to act as a deterrent for stopping the Users from engaging in the misuse of the website and causing the Practitioner to lose his/her business hours.
  • 3.4.6 Cancellation and Refund Policy
    • As per the Vaxisure policy, a ‘due date’ of two days before the appointment date is provided to the User, after which the complete consultation fees will be sent to the Practitioner’s wallet and cannot be refunded. After the due date, the doctor cannot be changed and once the payment is received by the doctor, the User cannot cancel the appointment, only reschedule to get their money’s worth. Any kind of refund due to cancellation will only be allowed before the due date.
    • In case the User or the Practitioner cancels the appointment before the due date, the entire consultation fees as per mentioned on our website will get refunded automatically to the User’s Vaxisure wallet. The amount in the wallet can be redeemed for use of some other service of Vaxisure. In the rare case that the refund amount (availed before the due date) does not get transferred into the User’s Vaxisure wallet, the User is advised to write to the Vaxisure at support@Vaxisure.com within five business days since the refund amount should have been deposited.
    • In that scenario when the Practitioner with whom the User had scheduled a paid appointment through the website could not meet the User and did not inform the User before the due date , the User should write to Vaxisure at support@Vaxisure.com within five days time since the appointment cancellation had occurred. In that case, Vaxisure will take appropriate actions to make sure that the User does not suffer from any financial loss.
    • Vaxisure is not liable to provide any refund in that case where the Practitioner was unable to meet with the User at the exact appointment time and lead the User to wait, irrespective of the fact whether the User chose to wait or decided not to obtain the healthcare service from the concerned Practitioner. However, the user can write to support@Vaxisure.com or send feedbacks at feedback.vaxisure in case of facing any such inconvenience due to the Practitioner like rescheduling/ cancellation after the due date and unnecessary delay in the appointment time, in which case Vaxisure will take appropriate actions against the Practitioner.
3.5 NO PATIENT/PROFESSIONAL RELATIONSHIP; NOT INTENDED FOR EMERGENCY
  • 3.5.1 It has to be noted that some of the text, content, graphics, data, information, images, guidance, suggestions and other materials ( collectively termed as “information”) which could be accessed on the website (including the content and information given in direct response to the User’s postings or questions) may have been submitted by the individuals in the medical field. The provision of this kind of information should not indicate a licensed medical patient/professional relationship between you and Vaxisure and should not be understood as a medical opinion/ advice/diagnosis/treatment of a specific condition, but is provided only with the purpose of assisting you to locate appropriate health care from a qualified Medical Practitioner.
  • 3.5.2 Hereby it is expressly clarified that any Information obtained or received from Vaxisure, and its contractors, employees, sponsors, partners, licensors, advertisers, or others on the Website are intended informational purposes only. Vaxisure makes no warranties, guarantees or representations, whether implied or expressed, in context to the quality of work, professional qualifications, expertise or any kind of information accessible through the Website. Under no circumstance are we liable to any User for any action taken by them or decision made by relying on such information.
    • 3.5.3 The Services on the website should not be considered a substitute of being in contact with emergency medical services. In the case of an End-User suffering from an emergency medical condition, it is suggested to contact a hospital or ambulance services directly.
3.6 CONTENT COPYRIGHT AND OWNERSHIP
  • 3.6.1The content presented on the website is either (i) generated by user or ii) belongs to Vaxisure. All the information that is gathered by Vaxisure either directly or indirectly from the Practitioners and End-Users would become the property of Vaxisure. Copying of any such copyrighted content displayed by Vaxisure on its website for commercial purposes or for intending to earn profit will violate the copyright laws
  • 3.6.2 Vaxisure provides the authorization to the User for viewing and accessing the content displayed on the website for the sole purpose of receiving, ordering, communicating and delivering in accordance with the Agreement. The information present on the website including text, content, graphics, logos, images, designs, buttons, software code, design and icons, ( collectively called Vaxisure Content) and act of collection, assembly, arrangement of the information, are solely the property of Vaxisure and are under the protection of trademark, copyright and other laws. Users are not allowed to modify the Vaxisure content or display, reproduce, distribute, publicly perform or in any way use the Vaxisure content either for public or for commercial purposes or for any personal reason.
3.7 REVIEWS AND FEEDBACK
  • Through the act of using the website, the User agrees that any kind of information shared by them with Vaxisure or with a Practitioner on Vaxisure will be subjected to our Privacy policy.
  • The user has to take the sole responsibility for any of the content that he/she decides to submit for the purpose of publishing on our website, including any ratings, reviews or feedbacks("Critical Content") pertaining to other Medical professionals. Vaxisure's role during the publishing of Critical Content is limited to the position of an 'intermediary' in accordance to the Information Technology Act, 2000. Vaxisure disclaims any responsibility regarding the information provided in the Critical Content and does not accept any liability for paying any consideration to the User for the purpose ofre-publishing and displaying any information across the different platforms.
  • You agree that Vaxisure does not authorize you to publish or post any content on our website which (i) causes infringement of the intellectual property of a third party or leads the privacy rights to be publicized or (b) causes a violation of any applicable regulation or law, including but not restricted to SPI rules and IGI rules.
  • It is the sole discretion of Vaxisure to decide whether the reviews and feedbacks need to be published or not and if so, are in accordance to the applicable laws. You are in complete agreement that Vaxisure can contact you either through SMS, email or using any other electronic communication method to fulfill the following purposes:
  • Obtaining the feedback regarding the websites or any of the services of Vaxisure.
  • Obtaining the feedback regarding any Practitioners who have been listed on our website; and/or
  • Answering queries, complaints and information wanted by the Practitioners regarding the Critical content on the website.
  • You are in complete agreement of providing your full cooperation regarding any further communication with Vaxisure. The Feedback collection and Fraud Detection Policy of Vaxisure, will always be subject to the terms of the Agreement mentioned here.
3.8 VACCINATION SERVICES
  • It should be clear to the user as well as the practitioner that the vaccines displayed on the website are not meant to endorse or promote any brand or company.
  • It is completely at the discretion of the user about which brand of vaccine he/she selects from the doctor, its cost and any other characteristics regarding it. Vaxisure accepts no liability for any damage or negative effect the vaccine may have on the user due to the negligence of the Practitioner or the bad quality of the vaccine.
  • The prices indicated for the Vaccination services are exclusive of the fees that would be charged by the doctor. The user is in complete agreement that any services provided by our website for which the user has to pay including but not limited to vaccination, booking and online shop services exclude the fees to be paid to the doctor.

4.TERMS OF USE FOR PRACTITIONERS

The terms provided in the Clause 4 can be applied only to the Practitioners.

  • 4.1 LISTING POLICY
  • 4.1.1 Vaxisure, either directly or indirectly, gathers information about the profiles, practice and contact details of the Practitioners. Vaxisure has the complete right of taking down the profile or displaying the profile of any Practitioner, with or without prior notice being sent to the Practitioner. The purpose of collecting this information is to facilitate the interaction with the Users, including the End-Users. In case the Practitioners find any information regarding them or their profile to be incorrect, it is important for them to immediately inform Vaxisure so as to make the necessary modifications.
  • 4.1.2 Vaxisure accepts no responsibility or liability regarding the ranking of our Practitioners either on search engines or external websites.
  • 4.1.3 Vaxisure accepts no responsibility or liability for any damage, losses, expenses or injuries incurred by the Users due to any publications or disclosures made by Vaxisure, where an explicit or implicit content was already granted by the User publications or disclosures made by Vaxisure. If the consent had been revoked by the User within the terms of the Privacy Policy, then no responsibility or liability will be accepted by Vaxisure for any damage, losses, expenses or injuries incurred by the Users due to any disclosures made by Vaxisure before receiving the actual receipt of the revocation demanded by the User.
  • 4.1.4 Vaxisure has the right to modify and moderate the opinions and suggestions made by our Practitioners through the feedbacks and has the authority to remove any or promotional, inappropriate or abusive content added to the Website.
  • 4.1.5 Practitioners are in complete agreement that Vaxisure has the right to publish the information and content submitted by the Practitioners including but not limited to third-party platforms.
4.2 PROFILE OWNERSHIP AND EDITING RIGHTS
  • Vaxisure provides an easy medium to the Practitioners for updating their profile information. Vaxisure has the right to own all the information contained in the profile including the photos and to moderate the updates and the changes and are requested by the Practitioners. However, it is solely the discretion of Vaxisure whether the requests made by the Practitioners need to be accepted or requested. Hereby you warrant and represent that you are completely entitled to publish all the uploaded content which is the part of your profile or of other portion of Vaxisure, and that none of that content breaches the third party rights, including but not restricted to intellectual property rights. In case Vaxisure is intimated of any such breach in the representation, Vaxisure reserves the right to delete or modify the sections of your profile information with or without prior notice to you.
4.3 FEEDBACK AND REVIEWS DISPLAY RIGHTS OF VAXISURE
  • 4.3.1 All the critical content of this website is submitted and developed by the Users of www.vaxisure.com. along with the clients of Vaxisure Practitioners and customers, consisting of the End-Users.  Vaxisure's role during the publishing of Critical Content is limited to the position of an 'intermediary' in accordance to the Information Technology Act, 2000. Vaxisure disclaims any responsibility regarding the information provided in the Critical Content.
  • 4.3.2 Vaxisure has the right to collect all the Critical Content and feedback pertaining to all the Clinics, Practitioners and Healthcare Providers being listed on the Website.
  • 4.3.3 It is not the obligation of Vaxisure to pre-screen, flag, review, filter,modify or remove all or any of the Critical Content from our services, except those needed to be modified as per the applicable law.
  • 4.3.4 You are to understand that the use of this website might expose you to some information like Critical content or other that may seem objectionable and offensive to you. Vaxisure accepts no liability for any kind of effect this content may have on the business of the Practitioner, especially due to a negative kind of content. In context of this, you are suggested to use the service and the website at your own risk.
  • 4.3.5 If Vaxisure is made aware that the information provided by you is  inaccurate or that fraudulent feedback is enabled by you, Vaxisure reserves the complete right of immediate suspension of any of your Vaxisure accounts along with declaring it on the website beside your name/clinic's name for the purpose of protecting its business as well as safeguarding the interests of the users.
  • 4.3.6The Practitioner is allowed to reschedule the appointment but not cancel appointment after the due date (when he would have received the complete payment from the user). The Practitioner is to understand that if Vaxisure receives any complaint against the Practitioner through support@Vaxisure.com or from User feedbacks at feedback.vaxisure, including but not limited to like cancelling the appointment after the due date or deliberate delay in treating the patient, Vaxisure has complete rights to take appropriate action including initial warnings followed by closing the account of the Practitioner in case of repeated misdemeanours.
4.4 RELEVANCE ALGORITHM
  • The relevance algorithm developed by Vaxisure is intended to be in the best interest of the user and may be adjusted from time to time for the purpose of improving the quality of the results given to the patients. This is a proprietary algorithm that is completely merit-driven and cannot be changed for specific Practitioners. Vaxisure accepts no liability regarding the effect the Relevance algorithm can have on the business interests of the Practitioner.
4.5 INDEPENDENT SERVICES
  • Regarding your use of the services offered by Vaxisure, you are only associated with the obligations and rights that are related to each service, and not to other services which are being provided by Vaxisure.

 

5. OBLIGATIONS AND RIGHTS RELATING TO CONTENT

5.1 The users are hereby informed by Vaxisure that they are not authorized and permitted to display, host, upload, publish, modify, update or transmit or share any kind of information, including but not limited to:
  • Content belonging to another individual and beyond the rights of the user
  • Content that is grossly harassing, harmful, defamatory, blasphemous, pornographic, obscene, libelous, pedophilic, invading other's privacy, hateful, ethnically, racially objectionable, encouraging or relating to gambling or money laundering,or unlawful in any other manner in a way which;
    • Causes harm to the minors in any way;
    • Leads to the infringement of trademark, copyright, patent, or any other type of proprietary rights;
    • Causes violation of any law which is in force for the time being;
    • Is deceiving or misleading in the context that the addressee is cheated regarding the origin of the messages
    • Is created by impersonating other people;
    • Is infected with software viruses or other kinds of computer code, programs or files having the intent of interrupting, destroying or limiting the functionality of the infected computer resource;
    • Is threatening to the integrity, unity, security, defence, or the sovereignty of India, it’s friendly relations with the foreign states, prevents the investigation of any kind of offence or has the potential to insult any other nation.

5.2Additionally, Users are prohibited from:

  • Causing violation or making an attempt to violate the security or integrity of any content of the Vaxisure website or its content by;
    • Transmitting the information (including messages, hyperlinks job posts) on or through our Website which can disrupt or competes with the services provided by Vaxisure;
    • Submitting intentionally on our Website any information that is false, inaccurate or incomplete;
    • Engaging in unsolicited communications with other Users;
    • Making use of software, engine, agent, device or tool (such as robots, spiders, intelligent agents or avatars) for navigating and searching the Website;
    • Making an attempt to decompile, decipher, reverse engineer or disassemble any section of the Website;
    • Duplicating or copying in any form of any kind ofVaxisure Content or any information that can be accessed from our website;
    • Trying to frame, hotlink or deep-link any content of Vaxisure.
    • Disabling or circumventing the usage rules, digital rights management, or any other type of security features of our Software.

5.3 In case of non-compliance with any applicable laws, rules or regulations, or the Agreement (including the Privacy Policy) by a User, Vaxisure has the right to immediately terminate the access or usage rights of the User to the Website and Services and to remove non-compliant information from the Website.

5.4 Vaxisure has the right to transfer or disclose any User-generated information to the governmental authorities or its affiliates in a way authorized or needed by the applicable law, and the User hereby consents to such a transfer. The SPI Rules only permit Vaxisure to transfer or send sensitive personal information, including the one to any person or corporate body in India, or in any other country, which ensures the similar amount of data protection that is adhered to by Vaxisure as governed by the SPI Rules, only if such a transfer is mandatory for the action of the lawful contract between any person and Vaxisure in a case where the User has give his consent for data transfer.

6.TERMINATION

  • 6.1 It is the sole right of Vaxisure to terminate or suspend the access of a User to our Website and its Services with and even without prior notice and to remedy and resolve the issue as per the law, including the cases where,
    • The terms and conditions mentioned in the Agreement are breached by the User;
    • The use of your services has to lead to the breach or violation of any rights as reported by a third party;
    • The user has provided such information that cannot be verified or authenticated by Vaxisure;
    • There are reasonable grounds for Vaxisure to suspect any fraudulent, abusive or illegal activity carried on by the User; or
    • Vaxisure is completely sure and has the right to assess the actions of the User and is sure that it can create legal liability for the User, the other Users or for Vaxisure or are against the website's interests.
  • 6.2 Once terminated, indefinitely suspended or temporarily suspended,  the User should not use the same account, or a different account for using the Website. Re-registering using a new account is also not allowed. When the user's account is terminated for the reasons mentioned herein, such User will no longer be able to access the messages, files, data, or any other material being submitted to the website by the User.

7.LIMITATION OF LIABILITY

  • Under no circumstance, including but not restricted to negligence, shall Vaxisure, or any of its officers, directors, employees, service or content providers or any agents (collectively called the "Protected Entities") would accept any liability for any kind of direct or indirect, incidental, special, exemplary, punitive, or consequential damages that might have arisen from or could have been directly or indirectly associated with, the usage or the inability of using the content, materials, functions or the Website itself.

 8.RETENTION AND REMOVAL

  • Vaxisure is allowed to retain any information gathered from the Users through their usage of the services or the website for as long as is required, based on the kind of information; purposes, modes and means of usage of the information; and within the domain of the SPI Rules. The web server logs may also be preserved by Vaxisure as long as is necessary for the administration.
